- On Day 19 of the Lindsay Clancy murder trial, defense attorney Kevin Reddington motioned for a mistrial over religious testimony from psychologist Kirk Heilbrun.
"I have to move for a mistrial," Reddington said. "The reason is – this is intentional misconduct on the part of the prosecution."
Earlier in the trial, Assistant District Attorney Jennifer Sprague mentioned mortal sin when questioning Sue Clancy, Patrick Clancy's mother. Reddington objected, but didn't move for a mistrial at that time.
"I felt the court's instructions were sufficient," Reddington said of the previous occurrence. "Unfortunately at this point, ... this is just over the top. It's the same thing again - talking about religion. Talking about heaven."
Sprague said she didn't ask about mortal sin, but the witness, Dr. Heilbrun, mentioned mortal sin as part of his testimony about his discussions with Clancy.

The Lindsay Clancy murder trialenters day 18 of testimony Friday, Aug. 21, at Plymouth Superior Court. The defense continues to argue Clancy was not criminally responsible when she strangled her three children to death in January 2023.
After testimony from Brigham and Women's Hospital chaplain Sheila Cavanaugh on Thursday, Aug. 20, Judge William Sullivan dismissed the jury and discussed jury instructions with the attorneys, a sign the trial is drawing to an end. Closing arguments could come as soon as Monday or Tuesday, Sullivan said.

- After the lunch recess, the prosecution continued its examination of Dr. Avram Mack. Assistant District Attorney Buckingham asked if Clancy retained the ability to conform her behavior with the law and appreciate the wrongfulness of her acts.
"There were moments she thought about harming the children, she was aware in those moments that that was wrong or against the law and that she could be punished for such an act," Mack said.
Buckingham noted Clancy reported being horrified at Brigham and Women's. "The feeling of shame that comes from being horrified indicates that she was aware that it had been the wrong thing to do," Mack said.

- The jury returned to the courtroom after a nearly 40-minute break to address technical difficulties with the remote testify from Cleveland-based forensic psychiatrist Phillip Resnick.
Over his career, Resnick has elevated about 80 patients who have killed their children and he previously consulted on several high-profile cases: serial killer Jeffrey Dahmer; Ted Kaczynski, known as the Unabomber; and Casey Anthony, who was acquitted in 2011 of murder for her 2-year-old daugther Caylee.
Resnick said he spent three hours interviewing Lindsay Clancy and two hours interviewing her parents in May 2023, about five months after she killed her children.
