Takedown Policy

  1. Purpose: The purpose of this policy is to provide a mechanism to amend any issues and/or for the removal or disabling of access to any content that is alleged to infringe on the intellectual property rights of others on TheNewsAccess.com.
  2. Reporting Infringements: If you believe that your intellectual property rights have been infringed upon by content hosted on TheNewsAccess.com, please provide the following information in a written notice to our designated agent at legal@thenewsaccess.com:
  • A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  • Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.
  • Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit TheNewsAccess.com to locate the material.
  • Information reasonably sufficient to permit TheNewsAccess.com to contact the complaining party, such as an address, telephone number, and, if available, an email address at which the complaining party may be contacted.
  • A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  1. Takedown Procedure: Upon receipt of a valid notice of infringement, TheNewsAccess.com will expeditiously remove or disable access to the allegedly infringing content. TheNewsAccess.com will also notify the user who posted the content of the takedown, and provide them with a copy of the notice of infringement.
  2. Counter-Notice: If a user believes that the content that was removed or disabled was done so in error, they may submit a counter-notice to TheNewsAccess.com’s designated agent at legal@thenewsaccess.com. The counter-notice must include the following information:
  • A physical or electronic signature of the user.
  • Identification of the removed or disabled content and its location before removal.
  • A statement under penalty of perjury that the user has a good faith belief that the content was removed or disabled as a result of mistake or misidentification.
  • The user’s name, address, telephone number, and email address, and a statement that the user consents to the jurisdiction of Federal District Court for the judicial district in which the address is located, or if the user’s address is outside of the United States, for any judicial district in which TheNewsAccess.com may be found, and that the user will accept service of process from the person who provided notification of the alleged infringement.
  1. Repeat Infringers: TheNewsAccess.com will terminate the account of any user who is determined to be a repeat infringer.
