- Cardell Hayes declined to plead guilty as expected Wednesday morning over the 2016 shooting death of retired Saints defensive star Will Smith, leaving several members of Smith's family in grief as they left an Orleans Parish courtroom.
Criminal District Court Judge Camille Buras set a new Feb. 5 date to retry Hayes over the killing of Smith and the shooting of his wife, Racquel, on a Lower Garden District street.
Hayes, 36, stood but said nothing in a black suit, white shirt and braided hair as District Attorney Jason Williams announced in court that Hayes had backed away from pleading guilty as charged to manslaughter.
“There was an intention to accept responsibility as charged,” Williams said. “If in fact Mr. Hayes has decided not to accept responsibility for what happened on this date ... we need to pick a trial date.”
