The PSC has opposed Cape Union Mart's court bid to stop protests, arguing the retailer is seeking an order that would unlawfully restrict political speech.
Arguing in the Western Cape High Court on Wednesday, the PSC's lawyers said slogans used during demonstrations about the Gaza war amounted to protected political commentary and hyperbole, and not defamation.
Cape Union Mart and its chairperson, Philip Krawitz, insist the protests outside its stores have crossed the line into unlawful conduct.
As heated protests from both sides ensued outside court, during proceedings on Wednesday, the PSC pointed to factual disputes, including who was responsible for certain protest messages.
